Terms & Conditions (Sports)


In consideration of permission to use the property, facilities and services of SODA ACADEMY (“SODA”), such use including, but not limited to, use of SODA’s facilities or equipment, participation in SODA programs or activities, and observation of any of the foregoing, I, on behalf of myself and my child(ren), hereby acknowledge and agree to the following:

  1. I hereby affirm that my child is in good physical condition to exercise. His/Her participation is purely voluntary and in no way mandated by SODA. Also, I understand that he/she can stop anytime if he/she has any discomfort or even without any particular reason. In NO event shall SODA, their directors, employees, organizers, coaches, or agents (“SODA STAFF”) be held liable for any injury, death, or property loss which he/she may suffer during the activities if caused by either his/her own negligence, inadequacies in health and fitness, or by accident.
  2. I hereby also affirm to bear the sole risk of injury resulting from my or their use of the property, facilities or services of SODA and hereby assume full responsibility for a risk of any bodily injury, death or property damage arising from such use, whether caused by the negligence of SODA STAFF or otherwise.
  3. Policies and Rules - I understand and agree that my child must abide by SODA’s policies and rules and the instructions of the SODA STAFF at all times, and that my child’s failure to do so will result in his/her immediate dismissal from SODA. Some of these policies, rules, and instructions are written and some are at the sole discretion of the SODA STAFF; however, it is understood that all policies, rules, and instructions seek at all times to ensure the overall safety of SODA and each of its participants. I acknowledge and agree that no part of the tuition paid will be refunded to me should my child be dismissed from SODA.
  4. I understand and agree SODA has the right to cancel a course. If a course is cancelled, I understand that I may enrol my child in another course and I will be responsible for any costs for the new program that are above the amount paid for the original course. If there are no other suitable courses, a refund will be issued for all monies paid to SODA for the cancelled course.
  5. I understand and agree that if SODA is forced to close a course based on a recommendation by the local Health Services Department (in the case of a communicable disease outbreak, etc.) or due to other acts of nature, I will not be entitled to a refund.
  6. Class Changes, Cancellations and Refunds
    • I understand and agree that if I need to change the time of a class for my child, of which was registered and confirmed, I must submit and confirm SODA ADMIN at least 48 hours prior to class starts, otherwise it will be treated as absence. SODA will not accept class any change requests due to any reason within 48 hours prior to class starts and no refund, reduction or prorate in the tuition will be made.
    • No refund, reduction or prorate in the tuition will be made after the course begins. If classes are purchased in the composition of a package, class credits exchanged by the package will have an expiration date. After expiration, class credits will become invalid, and no extension, refund, reduction or prorate will be made.
    • Absence due to sickness - Should my child be unable to attend the classes due to sickness, then a doctor’s note must be presented, upon which credit will be applied for the missed class(es), however no refund, reduction or prorate in the tuition will be made.
    • Refunds and make-up classes will NOT be issued for missed classes (for any reason), withdrawal or dismissal (for any reason) including sickness without doctor’s note presented, behavioural dismissals, weather, and unforeseeable events not within the control of SODA or other acts of nature.
    • Any changes or cancellations to my child’s registration will only be valid if made through a written request by email sent to [ contact@soda.academy ] or WhatsApp to [ +852 7073 9640 ].
  7. Weather Conditions
    • Apple (K1-3): In the event of Typhoon Signal 3 or higher, or Red/Black rainstorm signal (unless lowered 2 hours before the session is scheduled to commence), other bad weather situations, the session(s) will be cancelled.
    • Grape (P1-6) & Pear (F1-6): In the event of Typhoon Signal 8 or higher, or Black rainstorm signal (unless lowered 2 hours before the session is scheduled to commence), other bad weather situations, the session(s) will be cancelled.
    • For sessions(s) cancelled due to bad weather situations, the lesson fee will be credited towards future enrolments for SODA services (including parties, camps, events or classes- both private and public), valid for up to one year.
    • For Outdoor Classes only, in the case of a session being rained off within 15 minutes of starting, class will be cancelled and one session’s credit will be awarded. In this case, SODA STAFF will contact the parents/guardians to collect the children as soon as possible. If this is not possible, then SODA STAFF will look after the children until the initially stated class ending time.
    • Otherwise if being rained off after 15 minutes of the session, then SODA STAFF will take the children to shelter and attempt to resume the class when appropriate and no credit will be applied.
  8. Audio-Visual Waiver - SODA may photograph or videotape during his/her participation in the activities of SODA, and consent to the reproduction of such photos or videos for advertising and publicity, training and quality assurance purposes. I retain the right to request that any video recording of my child be deleted by SODA and recognize that videos will be deleted as deemed technologically practicable by SODA.
